FFLC Secures Victory for Virginia School Board Member Alliance
Founding Freedoms Law Center (FFLC) recently secured an important legal victory on behalf of the School Board Member Alliance (SBMA). SBMA is a professional membership organization for Virginia school board members that promotes high-quality school board governance training and other services to its members.
After York County government officials took baseless and unlawful actions to permanently suspend SBMA from contracting with the county to provide school board training seminars, etc., FFLC stepped in to demand that York County reverse its decision. You can read our demand letter here.
FFLC informed York County that its adverse action against SMBA “should be reversed because it was made without lawful authority, was arbitrary and capricious, violated the First Amendment, and violated the Due Process Clause.” Only days later, York County retracted its wrongful action, rescinding its prior adverse determination, and vindicating SBMA.
SBMA’s then-Executive Director Sherri Story said: “After county officials went out of their way to target and disparage SBMA, presumably for political reasons, our attorneys appealed the county's actions on our behalf, pointing out all the ways they failed to follow the law and even their own local regulations for public contracting. Thankfully, York County wisely reversed course, issuing a letter declaring ‘I rescind the determination [against] SBMA.’”
